Child Support/Spousal Support

Barbara E. McNamara - California Divorce & Family Law Attorney

Child Support/Spousal Support My name is Barbara E. McNamara. Since I founded my family law firm in 1997, I have helped both fathers and mothers as clients to determine their child support issues.

Whenever children are involved, whether they were born during the marriage, and the parents are going through a divorce, or the child was both outside of marriage, and the parents are now involved in a paternity action (or custody battle,) child support will be at issue. The custodial parent often wonders, how am I going to make it on my income alone? The parent who has less custodial time often thinks, how much child support will I have to pay?

California's Child Support Guidelines is Statutory.

I can help you answer these questions! In California, the State Legislature has adopted the Uniform Child Support Guidelines which are predicated upon a specific mathematical formula. Most attorneys use court approved software in order to determine what is called the Guideline Child Support. The amount of child support ordered depends upon several factors, including but not limited to, the percentage of time each parent spends with the child, how many children there are, the relative gross incomes of the parties, which parent pays for health insurance and the monthly premium paid, the tax filing status of each parent, the mortgage interest paid and property tax paid on any real property owned by the parties, to name a few. At the Law Office of Barbara E. McNamara, I know the rules in calculating child support and can help you determine how much you will have to pay, or how much you will receive, or if a modification of  your current order should be requested. Contact the office today to arrange a low-cost consultation.

Spousal Support - What is the difference between Temporary and Permanent Orders?

Assuming that you are getting a divorce and have limited working experience, you may be wondering what you can expect to receive in spousal support. What if your husband was the breadwinner and you stayed at home to raise the children? What can you do? At the Law Office of Barbara E. McNamara, I can help you determine how the Court will order temporary spousal support until the judgment is completed. I can also help you settle on, or litigate, the permanent spousal support you may be entitled to, depending upon several factors set forth in California Family Code §4320. Can you afford to go back to school to get more training? Can you afford to pay the bills? In appropriate situations, as your attorney, I will help ensure you continue the standard of living you are accustomed to by advocating for spousal support to be paid to you. If you are the one paying support, I can help you determine whether the amount you are paying is a fair amount, based upon the facts of your case.

The bottom line is, I want you to be secure financially as you move forward with your life.
