Domestic Violence

Barbara E. McNamara - California Divorce & Family Law Attorney

Domestic Violence My name is Barbara E. McNamara. As an experienced family law lawyer, I have seen the sometimes devastating effects which domestic violence can have on a family. Often, clients don't realize they have been victims of domestic violence until they tell me their story. Sometimes, they are so accustomed to abuse, they think it's "normal," and must be endured. This is not the case. I know what it takes to stand up, stop being a victim and stop the abuse. Contact me today to arrange a consultation.

Know that domestic violence is not your fault.

Too often, victims of domestic violence believe it is their fault - that they should have loved more, complained less or kept the home cleaner. Our clients often believe that if they had only done one thing differently, their marriage would have been a healthy one. The reality is that domestic violence is a cycle, and unless it stops with you, the cycle will continue, and will teach your children that violence works even though it hurts.

I understand our clients' feelings of pain, sorrow and shame when they have been victims of abuse. In some cases, my clients are alleged perpetrators of violence they did not commit. Fortunately, there is a way to end the assault and abuse. With the Law Office of Barbara McNamara by your side, the Court will hear the story and decide who is telling the truth.

Divorce can help end the hurt.

If  you have been a victim of domestic violence, counseling can help, but nothing can fully return your life to the way it was before domestic violence left its mark on you and your children. Often, seeking a divorce is the only way out of the cycle of violence. It can allow you to recover from the pain today and give you hope for a better tomorrow. Most importantly, divorce can protect your children from a harmful parent.

I can help you obtain restraining orders.

Based upon the facts of your case, I can help you obtain either a "domestic violence temporary restraining order," (known as a "DVTRO") followed by permanent restraining orders which can last for up to five years. Keep in mind, the orders are a piece of paper and won't stop a bullet. But hopefully, the orders will be followed and will keep you and the children safe from further harm. At the Law Office of Barbara McNamara, I will do the following for you:

  • I will listen to your story to fully understand your facts and circumstances
  • Gather testimony about the abuse from you, your children, other family members and friends
  • Help you file a temporary restraining order against your spouse
  • Help ensure you receive full physical custody of your children

No one can completely end the pain caused by spousal abuse, but I can help by guiding you through the divorce process. Please call me or e-mail me for more information.
